I've seen players over the years with much better excuses still not get waivers. He and his family hired a high priced lawyer and that did the trick. There was some comments about threats to take the whole policy to court, and the NCAA was concerned that in court this policy could be scrapped completely. The NCAA ended up backing down. Its unfair for the regular kid that comes from a low income or middle class income, they have to get bullied by the NCAA and abide by their rules.
