Sorry to bring it up in an article that shows what a special place ND is, but I just thought there were rumors about the St. Mary's student, and never thought any of it was corroborated. Does someone want to give me a quick primer on it?

It's been a while since I've read about it, but here is what I remember. There was a supposed sexual assault that took place at a party by a FB player on this young female. From what I read, everything was consensual until all the sudden it was not and the player I believed stopped when she said to stop. It was still reported and nothing came of it for a couple weeks, including the player not being contacted.

 

She then tragically took her own life. Not sure, nor is anyone, that it was a result of the assault, investigation or pressures from reporting it. For instance, someone sent the female a text to not mess with ND football.

 

No charges were ever filed which leads me to believe there either wasn't evidence enough or there was no actual criminal assault that took place.

 

I'm fuzzy on the timelines and by no means am I trying to discredit the young woman who is tragically gone. But I feel if there was an assault there, something would have come of it especially considering the media got a hold of the story.

Sad story, true. And admittedly, I reluctantly have a tough time rooting for the player...I shouldn't...but I find it tough...

Yes, she had a history of depression. No, she did not previously attempt suicide (that was a widely reported rumor with no substance).

 

The incident has been widely polarizing, with many in national media holding Kelly and Jenkins outrightly responsible for her death; some supporters of the program on the other hand have tried to dismiss the incident as the tragic fate of an unstable girl. Forde strikes the perfect balance with his introduction: "There are some who hold the program accountable...."

 

Personally, I've gone back and forth, as anyone with a heart and a wife or daughter would have to do. But ultimately, I choose to support the team for a few reasons: Prosecutors chose not to file charges because lack of evidence and an inconsistent testimony by Seeberg proved too difficult to overcome. Moreover, the player was not accused of rape, but of touching her breast and stopping when asked. Yes, any unwanted touching is assault; but without hearing his side of the story, it's not fair to label him a sex offender. What's the program supposed to do in this case? Suspend or expel a student against whom the charges don't stick?

I believe that her condition also necessitated that she transfer high schools and also colleges (to St. Mary's from Dayton, I believe).

Just to reiterate: she had not attempted suicide prior to this, and much of the speculation over her mental health has consisted of rumors. I say this not because I think you're engaging in this, but because so many ND supporters have tried to exculpate the player by quite reprehensibly casting the girl as crazy after she died. This is unfair to her and only validates those who see ND's handling of the situation as callous. The issue comes down to the fact that her accusation, which was misunderstood by many to be rape, lacked enough evidence to charge the student-athlete.
